Data processing terms

1. Roles

When you upload content that contains personal data about other people, you are the controller and Cognimate.Cloud is your processor. These terms form part of the Terms of service.

2. What is processed

Subject matter: providing Flintclip. Duration: for as long as you use it. Nature and purpose: storing, transcribing, analysing, cutting, captioning, writing copy for, sharing and publishing your videos. Types of data: images, voices and words of the people in your videos, and names typed by reviewers. People concerned: the people who appear in or are mentioned in your content, and your clients.

3. Our commitments

We process this data only on your documented instructions, which are these terms and what you do in the product.

People who work on the service are bound by confidentiality.

We apply the security measures described in the Privacy notice.

We help you answer requests from the people concerned and meet your own duties on security, breach notification and impact assessments, as far as the nature of the service allows.

We tell you without undue delay when we learn of a personal data breach affecting your content.

When you delete content or close your account we delete the data, except where the law requires us to keep it.

4. Other processors

You authorise us to use other processors in the categories listed in the Privacy notice. We put the same obligations on them and remain responsible for their work. We give notice of a new category of processor; you may object on reasonable grounds within 14 days.

5. Transfers

Where data is transferred across borders we rely on the safeguards recognised by applicable law, such as standard contractual clauses.

6. Audits

On reasonable written request, no more than once a year, we will give you the information needed to show we meet these terms. A signed copy of these terms for enterprise customers is available from support@myagentictoolbox.xyz.
